By accessing or using DeskCush services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

DeskCush provides learning and development consultancy services, including but not limited to: leadership development programmes, AI-powered learning solutions, L&D transformation consulting, global training delivery, and one-to-one AI coaching sessions.

3. Engagement Terms

All consultancy engagements are subject to a separate Statement of Work or Service Agreement that will outline: scope of services, deliverables, timeline, fees and payment terms, and intellectual property arrangements.

Services commence only after written agreement from both parties.

DeskCush retains all rights to methodologies, frameworks, and materials developed prior to or independently of client engagements.

Custom Deliverables

Materials created specifically for a client engagement are typically licensed to the client for their internal use, with specific terms outlined in the Service Agreement.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of services and typically lasts for 3 years unless otherwise specified.

To the fullest extent permitted by law, DeskCush shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the fees paid for the specific service giving rise to the claim.

9. Professional Standards

All services are provided in accordance with professional standards for learning and development consultancy. We maintain professional indemnity insurance and adhere to CIPD guidelines where applicable.

10. Termination

Either party may terminate ongoing services with 30 days written notice, unless otherwise specified in the Service Agreement. All fees for services rendered up to the termination date remain due and payable.

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
